Terms of Use

The current usage terms for the Baduz platform and related services.

Terms of Use of pabolo GmbH for the Baduz Platform

Provider. The Baduz platform is provided by pabolo GmbH, Albert-Nestler-Str. 10, 76131 Karlsruhe, Germany, represented by its managing director Thomas Hans Willberger (“pabolo”, “we”, “us”). Platform. Baduz is an AI-assisted game creation and distribution platform available at https://www.baduz.com (the “Website” and, together with all related services, the “Platform”). Registered users may create games as Creators. Visitors and registered users may discover and play public games as Viewers. Registered users may also comment on or vote on Games where these functions are available.

Application. These Terms of Use (the “Terms”) apply to access to and use of the Platform. A registered user enters into a free User Contract with pabolo. A Creator who purchases a paid plan additionally enters into a Subscription Contract. Visitors who use public parts of the Platform without registration must comply with the provisions applicable to Viewers, but do not enter into a User Contract merely by playing a public Game.

Consumers and entrepreneurs. Certain provisions apply only to consumers within the meaning of Section 13 of the German Civil Code (BGB) or to entrepreneurs within the meaning of Section 14 BGB. A consumer is a natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession.

Contract language and storage. The contract language is English. These Terms are available in printable and storable form at https://www.baduz.com/termsofuse. The version accepted when the contract is concluded will be made available to the User on a durable medium, for example by e-mail or as a downloadable document in the User Account.

Conflicting terms. Any deviating, contradictory or supplementary terms of a User apply only if pabolo has expressly agreed to them in text form.

Part I. General Terms for the Use of the Platform

1. Registration and User Contract

1.1 A User Account is required to create Games, purchase or use a Subscription, comment on Games, vote, manage a Profile, or use other registered-user functions. Public Games may be played without a User Account unless the Platform expressly states otherwise.

1.2 Registration and login are provided through supported third-party identity providers using OAuth or OpenID Connect, currently including Sign in with Google. You authenticate directly with the identity provider. pabolo receives the account information made available by the provider that is necessary to create and operate the User Account. pabolo does not receive or store the password for your third-party account and does not independently verify the e-mail address supplied by the identity provider.

1.3 The free User Contract comes into effect when you complete registration through the identity provider, accept these Terms and we activate the User Account. We may display or send a registration confirmation.

1.4 Only natural persons who are at least 16 years old may register. A paid Subscription may only be purchased by Users who are at least 18 years old and have full legal capacity. Users under 18 may use the free User Account only. We may request reasonable evidence of age where legally required or where there are justified doubts.

1.5 Registration and the User Contract are free of charge. Paid Creator functions are governed by Part II.

1.6 Your User Account may be linked to a public Profile. A Profile may become visible when you publish a Game, comment or vote. You may select or edit the public Profile Information made available in the account settings. An e-mail address or identity-provider identifier is not displayed publicly by default. A name or profile image received from an identity provider is displayed publicly only where the Platform expressly allows you to select it for that purpose.

1.7 You must protect access to the third-party identity-provider account used for Baduz, keep active Baduz sessions secure, sign out on shared devices and notify us immediately at [email protected] if you know or reasonably suspect that the User Account or a linked login has been compromised. pabolo does not control the security of your credentials held by the identity provider. You are responsible for misuse only to the extent that you are responsible for it.

1.8 You may not sell, assign, lend or otherwise transfer your User Account to another person.

1.9 There is no entitlement to registration. We may reject registration for objective reasons, including security risks, prior serious violations, legal restrictions or unavailable capacity.

1.10 We communicate with you electronically using the e-mail address stored in your User Account. You must keep that address current and regularly check messages relating to the Platform.

2. Scope of Services, Beta Status, Updates and Availability

2.1 Baduz may be offered in whole or in part as a beta service. Beta functions may be incomplete, unstable, changed or discontinued and may produce errors. The current material functionality, compatibility and interoperability are described in Part V and on the Website.

2.2 We provide updates required to maintain contractual conformity and security for as long as required by applicable law and the relevant contract.

2.3 We may further develop or change the Platform without additional charge where there is a valid reason, including technical development, security, legal requirements, changes to third-party services, increased or reduced demand, prevention of misuse, or improvements for Users. We will provide information about material changes in a clear and comprehensible manner.

2.4 If a change materially and negatively affects a consumer’s access to or use of a digital product, we will provide the information and termination rights required by applicable law. Mandatory rights relating to changes of digital products remain unaffected.

2.5 Maintenance, upgrades, bugs, third-party failures, security incidents and circumstances outside our reasonable control may cause interruptions. Subject to the exclusions below, we aim to provide the Platform with an annual availability of 98%. Availability is calculated as the ratio of available hours to total hours in the relevant calendar year. Announced maintenance, force majeure, internet or third-party infrastructure failures outside our control, attacks, User-caused failures and legally required interruptions are excluded from the calculation. Statutory warranty rights remain unaffected.

3. Acceptable Use and Community Standards

3.1 You must not misuse the Platform. In particular, you may not:

  • impersonate another person or misrepresent the origin of content;
  • collect, store, disclose or exploit personal data of other persons without a lawful basis;
  • send unsolicited advertising, spam or deceptive commercial messages;
  • submit knowingly false or abusive reports or appeals;
  • interfere with, block, overwrite, damage or manipulate the Platform or another User’s content;
  • decompile, reverse engineer or disassemble Platform software except to the extent expressly permitted by mandatory law;
  • use bots, automation or traffic-generation systems that compromise security, integrity, availability or fair use;
  • gain or attempt to gain unauthorised access to systems, accounts or data;
  • crawl, scrape or collect Platform data by automated means without our prior written consent, except where mandatory law permits it; or
  • circumvent content restrictions, security controls, moderation measures, subscription controls or technical limitations.

3.2 The following content and conduct are prohibited in Games, Profile Information, comments and all other use of the Platform (“Prohibited Content”):

  • pornographic content, explicit sexual acts, sexual exploitation, sexualised depictions of minors, grooming or solicitation of minors;
  • extreme, graphic, sadistic or highly realistic violence, including graphic injuries, visible blood or gore, corpses presented as the result of violence, torture, executions, dismemberment or realistic suffering;
  • content that glorifies or instructs serious violence, terrorism, war crimes, self-harm, suicide or dangerous acts;
  • hate speech, dehumanisation, unlawful discrimination, targeted harassment, stalking, threats, doxxing or non-consensual disclosure of private information;
  • illegal content, fraud, phishing, malware, circumvention tools or instructions facilitating serious wrongdoing;
  • content that infringes copyright, trademarks, personality rights, privacy rights or other rights of third parties;
  • deceptive impersonation, non-consensual deepfakes or misleading synthetic depictions of real persons;
  • gambling for money or money-equivalent value, or other content prohibited by applicable law; and
  • content that, in our reasonable assessment, would require an age classification of 16 or 18 or would otherwise be unsuitable under the Baduz content standard.

3.3 Stylised combat or shooting mechanics may be permitted if they do not include Prohibited Content, in particular no blood, gore, corpses, graphic injury, torture, execution, dismemberment or realistic depiction of suffering. Permission depends on the overall context, presentation and intensity of the Game.

3.4 Baduz is designed to allow only public Games within a maximum 12+ content standard. Games that would require a higher age classification are not permitted to be published. This is a Platform rule and does not constitute an official classification by an authority or voluntary self-regulation body.

3.5 Detailed and updated Community Guidelines may explain these standards with examples. The Community Guidelines form part of these Terms. If there is a conflict, these Terms prevail.

4. Content Moderation, Reports and Appeals

4.1 At the date of this version of the Terms, pabolo uses human review before the initial publication of a Game. pabolo may also review Games and comments after publication. Publication or continued availability does not constitute legal approval, an official age classification, an endorsement or a guarantee that every violation has been detected.

4.2 At the date of this version of the Terms, pabolo does not use an automated content detector to make publication or moderation decisions. Reviews may include individual human review, risk-based review, spot checks and review triggered by a report. pabolo may introduce automated moderation or detection tools in the future, but will update the relevant product information and privacy information and implement legally required safeguards before using them for materially significant moderation decisions.

4.3 We may refuse publication, restrict discoverability, add warnings, disable functions, temporarily suspend access, unpublish or delete content, issue warnings, limit a User Account or terminate a contract where reasonably necessary to enforce these Terms, protect Users or third parties, address legal or security risks, or comply with orders or applicable law. We will take account of the nature, severity, frequency and consequences of the violation and the interests and fundamental rights involved.

4.4 Games and comments must have an easily accessible electronic reporting function. Reports should identify the content concerned and explain why the reporting person considers it illegal or contrary to the Community Guidelines. We may request contact details or additional information where necessary to process a report.

4.5 Where required, we will confirm receipt of a report and inform the reporting person of our decision. Users affected by a content restriction or account measure will receive a statement of reasons to the extent required by law and unless prohibited for security, investigative or legal reasons.

4.6 A User may challenge a moderation decision by using the appeal function made available with the decision or by contacting [email protected]. Unless a shorter period is stated for a specific measure, an appeal should be submitted within six months. Appeals are reviewed free of charge, with human involvement where appropriate. Further statutory remedies remain unaffected.

4.7 We may temporarily restrict access while a report is investigated if this is reasonably necessary to prevent significant harm, preserve evidence or comply with legal obligations.

4.8 Repeatedly submitting manifestly unfounded reports, manifestly unfounded appeals or repeatedly providing manifestly illegal content may result in a temporary suspension after prior warning where required. We consider the circumstances and severity before taking such action.

5. Profile Information

5.1 You remain responsible for Profile Information that you choose to make available on the Platform, including information received from an identity provider that you expressly select for public display. You grant pabolo a worldwide, non-exclusive, royalty-free and sublicensable right to store, reproduce, format, display and make that Profile Information publicly available to the extent necessary to operate your Profile, associate it with your Games and interactions, secure and moderate the Platform, and display the Platform’s normal sharing previews.

5.2 The licence under Section 5.1 lasts while the relevant Profile Information is stored or displayed on the Platform. It ends when the information is deleted or the User Contract ends, except for temporary backups, evidence, legal compliance and previously generated sharing previews that cannot reasonably be withdrawn immediately.

5.3 Use of a User’s name, image or Profile Information in a stand-alone external advertising campaign requires a separate legal basis where applicable. Normal presentation of public Profiles and Games within Baduz or in link previews is not a stand-alone endorsement campaign.

6. Warranty

6.1 The statutory warranty rules apply. Beta status and AI-related limitations do not exclude mandatory consumer rights.

7. Liability of pabolo

7.1 pabolo is liable without limitation for intent and gross negligence, for injury to life, body or health caused culpably, under the German Product Liability Act, for guarantees expressly assumed, and for fraudulently concealed defects.

7.2 In the event of a slightly negligent breach of an essential contractual obligation, meaning an obligation whose performance is necessary for proper performance of the contract and on which the User may regularly rely, pabolo’s liability is limited to the foreseeable damage typical for the contract.

7.3 In all other cases, liability for slight negligence is excluded. Mandatory statutory liability remains unaffected.

8. User Responsibility and Indemnification

8.1 You are responsible for your culpable violations of these Terms and applicable law.

8.2 To the extent legally permitted, you will indemnify pabolo against justified third-party claims resulting from content or conduct for which you are responsible. This obligation applies only to the extent you culpably caused the violation. We will notify you without undue delay, allow reasonable participation in the defence and will not enter into an unreasonable settlement at your expense without consulting you. Necessary and reasonable statutory legal costs may be included.

9. Suspension and Termination of the User Contract

9.1 You may terminate the User Contract at any time without notice by using the “Delete account” function or by e-mail to [email protected]. Deleting the User Account does not replace cancellation of a Subscription where the Subscription remains active under a separate billing arrangement; the interface will clearly explain any additional cancellation step required.

9.2 pabolo may ordinarily terminate the User Contract with two weeks’ notice effective at the end of a calendar month, but not before the end of an active Subscription period, unless we also validly terminate the Subscription.

9.3 The right of both parties to terminate for cause remains unaffected. Cause may include a serious or repeated violation, material security risk, fraudulent use, unlawful content, non-payment, or a legal prohibition on continuing the service. Where reasonable, we will first warn the User and provide an opportunity to remedy the breach.

9.4 Consequences for Games and Creator project data are governed by Part II. Statutory rights relating to digital products and personal data remain unaffected.

10. Customer Service and Contact Points

10.1 Customer service is available during our business hours at [email protected].

10.2 The contact point for Users and authorities in connection with content notices and the Digital Services Act is [email protected], unless a different contact point is published on the Website. Communication may be in German or English.

11. Privacy

11.1 Information about our processing of personal data, including account data, prompts, generated game data, moderation data and the involvement of AI or infrastructure providers, is available in our Privacy Policy at https://www.baduz.com/privacypolicy.

11.2 Non-essential cookies and analytics (such as Google Analytics) are used only with the User’s consent, which is requested separately from the acceptance of these Terms and is not a condition for using the Platform. Details, including how to withdraw consent at any time, are set out in the Privacy Policy and the Cookie Policy at https://www.baduz.com/cookiepolicy.

12. Consumer Dispute Resolution

12.1 pabolo is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board, unless a mandatory legal obligation applies in an individual case.

13. Applicable Law and Jurisdiction

13.1 The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in another country, mandatory consumer-protection provisions of that country remain unaffected.

13.2 Karlsruhe, Germany, is the exclusive place of jurisdiction for disputes arising from or in connection with the User Contract or Subscription Contract if you are a merchant, a legal entity under public law, a special fund under public law, or an entrepreneur established outside Germany, to the extent such agreement is legally permitted.

14. Changes to these Terms

14.1 We may amend these Terms for valid reasons, including changes in law or case law, security requirements, technical developments, changes to third-party services, prevention of misuse, clarification of ambiguities or changes to the Platform that do not alter the essential contractual character.

14.2 We will notify registered Users of amendments in text form at least six weeks before they take effect, unless a shorter period is required by law or necessary to address an urgent security or legal risk.

14.3 Material changes to prices, payment obligations, essential services or the scope of rights granted by a User require express agreement where legally required. For other objectively justified changes, the notice may provide that the amendment will be deemed accepted if the User does not object within six weeks, provided the notice clearly explains the consequences, the right to object and any termination right. Mandatory requirements governing amendments to digital products remain unaffected.

15. Transfer of Contract

15.1 pabolo may transfer the User Contract or Subscription Contract to an affiliated company or a purchaser of the relevant business, provided that this does not reduce mandatory User rights. We will notify you in text form. Where required, you will be given a reasonable right to terminate before the transfer takes effect.

16. Miscellaneous

16.1 If an individual provision is invalid or unenforceable, the remaining provisions remain in effect. The statutory rule applies in place of the invalid provision.

16.2 Headings are for convenience only. “Including” means “including without limitation” unless the context requires otherwise.

Part II. Special Terms for Creators and Subscriptions

1. AI-Assisted Game Creation Tool

1.1 pabolo offers Creators access to browser-based software that enables them to design Games using AI-assisted tools, including prompt-based functions for creating or modifying missions, objects and other game elements (the “AI Tool”).

1.2 The AI Tool assists the creative process, but the Creator selects, arranges, combines, edits and directs the elements of the Game. The quality and degree of human creative contribution may differ between Games.

1.3 The AI Tool may use third-party AI models, hosting providers or technical services. Functions may change if such services change or become unavailable.

2. Subscription Contract, Price and Payment

2.1 A paid Subscription is required to access the Creator functions identified on the order page. The available plans, prices, billing intervals, included usage limits, taxes and accepted payment methods are displayed before the order is submitted. Users with an active Subscription may additionally purchase packs of additional AI generation credits as one-time purchases at the price displayed at checkout. Purchased credits do not renew, are added to the credit balance and remain usable while the Subscription is active.

2.2 The presentation of a plan is not a binding offer. By clicking the clearly labelled payment or order button in the Baduz checkout or the checkout of our payment service provider Stripe, you submit a binding order. The Subscription Contract is concluded when we accept the order by confirmation or activate the paid functions, whichever occurs first.

2.3 Unless the order page states otherwise, a Subscription runs for the selected initial billing period and renews automatically for successive periods of the same length until cancelled. Consumers may cancel at any time with effect at the end of the current paid period using the statutory cancellation interface, the account settings or any additional method stated on the Website. Details on cancellations, withdrawal rights and refunds are set out in Part IV of these Terms.

2.4 Our order process is conducted via Stripe Managed Payments. Stripe’s affiliate Sold Through Link, LLC is the Merchant of Record for all our orders. Stripe provides all customer service inquiries and handles returns. Fees are due at the beginning of each billing period and are processed by Stripe, Inc. and its affiliates (“Stripe”). pabolo does not receive or store full card numbers, bank-account credentials, card security codes, payment-provider passwords or comparable payment authentication data. Stripe’s Consumer Terms of Service and privacy information apply to its processing and are available at https://stripe.com/legal/consumer. pabolo may receive limited transaction, billing and Subscription metadata required to conclude and administer the Subscription, verify payment status, process refunds or chargebacks and comply with accounting obligations.

2.5 If the payment service provider reports a failed, reversed or overdue payment, we may suspend Creator functions after appropriate notice. Statutory rights relating to default, refunds and termination remain unaffected.

2.6 No revenue share, creator payout, virtual currency, paid item marketplace or other monetisation of Games is offered under these Terms.

3. Subscription Functions and Usage Limits

3.1 During an active Subscription, the Creator may use the AI Tool within the plan limits to create, edit, store, submit, publish and share Games through Baduz.

3.2 Usage limits may include generation quotas, storage, processing time, number of projects or technical limits. Current limits are displayed on the order page or in the User Account.

3.3 Unused quota does not carry over unless the plan expressly states otherwise. We may apply reasonable rate limits and anti-abuse controls.

4. Immediate Consequences of Subscription Expiry or Termination

4.1 The right to use Creator functions and to have Games hosted or publicly provided as a contractual Subscription service ends immediately when the Subscription ends, irrespective of the reason for expiry or termination.

4.2 Unless a Game remains available as a voluntary courtesy under Section 4.3, pabolo will immediately unpublish the Creator’s Games when the Subscription ends and will initiate permanent deletion of the Games, project data and associated copies from active production systems without an additional grace period or further notice. Public links may stop working immediately. The Creator has no contractual right to continued hosting, access, editing, restoration or recovery after the Subscription ends.

4.3 If pabolo delays deletion, temporarily retains a Game or keeps a Game publicly available after the Subscription ends, this is a voluntary and revocable courtesy. It may be withdrawn at any time without notice, does not create a contractual right or legitimate expectation and does not guarantee restoration after a later re-subscription.

4.4 Technical backup copies may remain for a limited period under our backup, security and legal-retention processes, but are not available to the Creator and may not be capable of restoration.

4.5 Mandatory consumer, data-protection and other statutory rights remain unaffected.

5. Creator Inputs and Responsibility

5.1 “Creator Inputs” are prompts, instructions, names, text, dialogue, settings, selections, arrangements, mission designs, object configurations and other information or creative decisions entered or made by the Creator within the AI Tool. Creator Inputs may include reference images that the Creator uploads solely as a visual guide for a generation. Such reference images are processed only to produce the requested result; they are not stored by pabolo and do not become part of the Game. The Platform does not provide a general function for uploading audio, code or project files.

5.2 The Creator is solely responsible for Creator Inputs and for reviewing the resulting Game before publication. The Creator must not enter confidential information, personal data of third parties, trade secrets or content that the Creator is not authorised to use. Reference images must not depict identifiable persons and must not be used to reproduce the likeness of a real person.

5.3 The Creator represents that Creator Inputs and the intended Game do not violate applicable law, these Terms or third-party rights.

6. Rights in Creator Contributions and pabolo Materials

6.1 “Creator Contributions” are the Creator’s individual creative contributions to a Game, including protectable text, mission design, selection, arrangement and combination of elements, to the extent these contributions qualify for protection under applicable intellectual-property law.

6.2 As between pabolo and the Creator, the Creator retains any rights that arise in the Creator Contributions. pabolo does not claim ownership of the Creator’s copyright in such contributions.

6.3 Copyright protection does not arise merely from an idea, instruction, simple prompt, routine selection or purely machine-generated output. pabolo does not warrant that a Game, Creator Contribution or AI-generated element is protected, original, exclusive or free of third-party rights. Similar or identical outputs may be generated for other users.

6.4 “pabolo Materials” include the Platform, AI Tool, game engine, runtime, software, models, systems, templates, default assets, object libraries, interfaces, reusable components, technical structures, documentation, branding and all materials owned or licensed by pabolo independently of the Creator Contributions. All rights in pabolo Materials remain with pabolo or its licensors.

6.5 The Creator receives a limited, non-exclusive, non-transferable and non-sublicensable right to use pabolo Materials solely within Baduz and solely for the duration and scope of an active Subscription, except where the Platform voluntarily permits continued use. No right is granted to extract, export, separately exploit, reverse engineer or use pabolo Materials outside Baduz.

7. Licence Granted to pabolo

7.1 The Creator grants pabolo a worldwide, non-exclusive, royalty-free and sublicensable licence to use the Creator Inputs, Creator Contributions and Game to the extent necessary to provide, host, store, reproduce, execute, render, technically adapt, test, secure, moderate, make publicly available and distribute the Game through Baduz and normal Baduz sharing links.

7.2 The licence includes technical changes, format conversion, creation of previews, thumbnails or excerpts, interoperability measures, debugging and use by infrastructure, AI, security and distribution providers acting for pabolo. It also includes presentation and promotion of the Game within Baduz and in ordinary Baduz link previews.

7.3 The licence lasts while the Game is stored, processed, publicly available or retained as a courtesy under Section 4.3. It continues for temporary backups, evidence, legal compliance and defence of claims to the extent necessary. The Creator may request removal of a Game while the User Account exists, subject to technical processing time and mandatory retention.

7.4 pabolo will not use non-public Creator Contributions to train a general-purpose AI model unless this is clearly disclosed and supported by an appropriate contractual or data-protection basis. Product analytics, safety testing, abuse detection and improvement of non-generative Platform functions remain subject to the Privacy Policy and, where legally required, to the User’s separate consent.

8. Publication, Sharing and Public Access

8.1 A Creator may submit a Game for publication only during an active Subscription. Publication is subject to the Creator Declaration, the moderation process described in these Terms, technical checks and compliance with these Terms.

8.2 The Creator has no entitlement to publication, ranking, recommendation, a particular audience, uninterrupted availability or a specific public URL.

8.3 Sharing means sharing a Baduz link or using a sharing function provided by the Platform. It does not include downloading, copying, exporting, independently hosting, selling, licensing or distributing a standalone version of the Game or pabolo Materials.

8.4 Public Games may be played without registration. The Creator acknowledges that public availability can result in gameplay recordings, screenshots, commentary and links created by Viewers to the extent permitted by law and these Terms.

9. Creator Declaration and 12+ Content Standard

9.1 Before each initial publication and after any material change, the Creator must actively select a single mandatory checkbox confirming the Creator Declaration displayed in the publishing interface (the “Creator Declaration”). By making the Creator Declaration, the Creator confirms that the Game complies with the Baduz Community Guidelines and the maximum 12+ content standard, that it contains no Prohibited Content, that no content or functionality relevant to the declaration has been hidden or obscured, and that the Game may be reviewed, restricted or removed if it violates these rules.

9.2 The checkbox must be unchecked by default. The Creator Declaration is made by the Creator. It does not state that pabolo, the USK, an authority or a voluntary self-regulation body has assigned an official age classification or guaranteed the Game’s compliance.

9.3 Baduz may display an info text on Game pages reporting the Creator Declaration and the maximum 12+ content standard, clarifying that it is not an official USK rating and pointing to the report function. The notice reports the Creator’s declaration and is not an endorsement by pabolo.

9.4 The Creator Declaration does not reduce pabolo’s right or obligation to conduct moderation reviews, respond to reports, change or supplement displayed content information, restrict the Game or remove it. Automated tools may be introduced only as described in Part I, Section 4.2.

9.5 Knowingly false declarations, concealment of relevant content or repeated misclassification are material violations and may lead to immediate unpublishing, suspension or termination.

10. Review Does Not Constitute Approval or Guarantee

10.1 At the date of this version of the Terms, Games are individually reviewed by human moderators before initial publication. pabolo may also conduct spot checks, risk-based reviews and report-triggered reviews. A review is limited and does not constitute legal approval, an endorsement, an official age classification or a guarantee that all prohibited or unlawful content has been identified.

10.2 The Creator must test the full Game, including missions, objects, generated text, visual states, failure states and hidden or conditional content, before making the Creator Declaration. A material change may require a new declaration and a new review before republication.

11. No Export and Technical Dependence on Baduz

11.1 Games are created for and technically dependent on the Baduz engine, runtime, systems and pabolo Materials. They cannot be operated as standalone games outside Baduz.

11.2 No export function is provided. The Creator is not entitled to receive source code, a project file, a standalone executable, platform assets, model outputs as separate asset packages, or any other copy that can be operated outside Baduz.

11.3 The Creator acknowledges that technical deletion may be irreversible. Reactivating a Subscription does not create a right to recover previously deleted Games or project data.

11.4 Any mandatory statutory right to receive content remains unaffected. The parties acknowledge, however, that the complete Game and project are technically inseparable from Baduz and have no usable standalone format outside the Platform.

12. AI Limitations

12.1 AI-generated or AI-assisted results may be inaccurate, incomplete, unsuitable, similar to other outputs or inconsistent with the Creator’s instructions. The Creator must review results before publication or reliance.

12.2 pabolo does not warrant that AI results are unique, protectable, non-infringing, factually correct, secure or suitable for a specific purpose.

12.3 You must not use the AI Tool to create unlawful content, imitate a real person without an appropriate legal basis, circumvent safety systems or infer sensitive personal information.

13. Termination of the Subscription for Cause

13.1 Either party may terminate the Subscription for cause. pabolo may terminate or suspend immediately in the event of serious or repeated violations, false Creator Declarations, unlawful content, security abuse, fraud, chargebacks, non-payment after appropriate notice, or where continued service is legally or technically unreasonable.

13.2 The consequences in Section 4 apply when the Subscription ends. Statutory refund, warranty and withdrawal rights remain unaffected.

Part III. Special Terms for Viewers

1. Playing Public Games

1.1 Public Games may generally be played without registration. The Platform may introduce an account requirement for specific functions or where required for security, legal compliance or youth protection.

1.2 Subject to these Terms, pabolo grants Viewers a limited, revocable, non-exclusive and non-transferable right to access and play a public Game through Baduz for personal use. No right to download, copy, modify, extract, decompile, independently host or commercially exploit a Game or pabolo Materials is granted.

1.3 Viewers may share the public Baduz link and may create ordinary screenshots or gameplay recordings for lawful, non-commercial commentary or sharing, provided that this does not circumvent technical protections, disclose private information, mislead about affiliation, or violate third-party rights. pabolo may publish more detailed sharing rules.

2. Content Information and Reporting

2.1 Baduz may display content-suitability information based on the Creator Declaration. Unless expressly stated otherwise, this information is not an official USK rating, an endorsement or a guarantee by pabolo. Any such notice communicates the Creator’s declaration and does not describe the scope or result of an internal moderation review.

2.2 Public Games on Baduz are intended to remain within a maximum 12+ content standard. No 16+ or 18+ Games are permitted. Nevertheless, a Creator declaration or moderation review may fail to identify an issue. Viewers should stop playing and use the report function if they encounter Prohibited Content or content that appears materially inconsistent with the displayed information.

2.3 Parents and legal guardians remain responsible for supervising the media use of children in their care. The absence of a login requirement is not a guarantee that every Game is suitable for every individual child.

3. Comments and Votes

3.1 A registered User Account is required to comment or vote. Comments must comply with the Community Guidelines and may be moderated, hidden or deleted.

3.2 You retain any rights in your comment and grant pabolo a worldwide, non-exclusive, royalty-free and sublicensable licence to store, reproduce, display, format, moderate and make the comment publicly available within Baduz for as long as it remains posted, plus temporary backups and legal retention.

3.3 Do not post personal contact details, private information, advertising, harassment, sexual content, illegal content or links that create security or youth-protection risks.

3.4 Votes and rankings may be adjusted or removed to address manipulation, abuse, technical errors or policy violations.

Part IV. Right of Withdrawal and Refund Policy for Consumers

1. Withdrawal Instructions

Right of withdrawal. If you are a consumer, you have the right to withdraw from a distance contract within fourteen days without giving any reason, unless the right has expired under applicable law.

Withdrawal period. The withdrawal period is fourteen days from the date the relevant contract is concluded.

Exercising the right. To exercise the right of withdrawal, you must inform pabolo GmbH, Albert-Nestler-Str. 10, 76131 Karlsruhe, Germany, telephone +49 (0)157 58252145, e-mail [email protected], of your decision to withdraw by an unequivocal statement, for example a letter sent by post or an e-mail. You may use the model form below, but it is not obligatory.

Meeting the deadline. It is sufficient that you send the communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

Effects of withdrawal. If you withdraw, we will reimburse payments received from you for the withdrawn contract without undue delay and no later than fourteen days after the day on which we receive your withdrawal. We will use the same means of payment used for the original transaction unless expressly agreed otherwise; you will not incur fees as a result of the reimbursement.

Performance during the withdrawal period. If you expressly request that a service begin during the withdrawal period, you may be required to pay a proportionate amount for services supplied up to the time you inform us of the withdrawal. The withdrawal right may expire early only under the conditions provided by applicable law and after the confirmations required by law have been obtained.

3. Refund Policy

3.1 Our order process is conducted via Stripe Managed Payments. Stripe’s affiliate Sold Through Link, LLC is the Merchant of Record for all our orders. Stripe provides all customer service inquiries and handles returns. Approved refunds are paid out by Stripe to the original payment method, normally within fourteen days.

3.2 A Subscription can be cancelled at any time in the account settings or through the cancellation link in the Stripe receipt e-mail. Cancellation takes effect at the end of the current paid billing period and the paid functions remain available until then. Cancellation alone does not trigger a refund for the remaining days of a billing period that has already started, unless a statutory right or this Refund Policy provides otherwise.

3.3 If a consumer withdraws within the period described in Section 1 and expressly requested that the service begin during that period, the amount paid is refunded minus a proportionate amount for the service already provided, including AI generations already used before the withdrawal.

3.4 Statutory warranty rights are not limited by this Refund Policy. If a paid service is defective or unavailable in a way pabolo is responsible for, contact [email protected] and we will remedy the issue or arrange an appropriate refund through Stripe.

3.5 A refund can be requested by e-mail to [email protected], stating the e-mail address used at checkout and the Stripe order number, or from Stripe directly using the link in the receipt e-mail or at https://support.link.com. We and Stripe may decline refund requests that constitute abuse, for example repeated purchase-and-refund cycles after the service has been used.

3.6 If a charge appears incorrect, please contact us or Stripe first so that the matter can be resolved. Initiating a chargeback for a valid charge may lead to suspension of the associated account and additional costs.

3.7 For one-time purchases of AI generation credit packs, where the checkout asks for your express consent to immediate delivery and your acknowledgment that you thereby lose the right of withdrawal, the withdrawal right expires when delivery begins. Credits that have already been consumed are in any case non-refundable.

Part V. Service Description

1. Core Functions

  • Account registration for users aged 16 or older;
  • paid Subscriptions;
  • one-time purchases of additional AI generation credit packs for active subscribers;
  • browser-based AI-assisted creation and editing of Games for Creators with an active Subscription;
  • prompt-based creation or modification of missions, objects and other supported game elements;
  • storage, publication and public execution of Games during an active Subscription, subject to these Terms;
  • public playing of published Games without a User Account;
  • sharing of public Baduz links;
  • registered-user comments and voting where enabled;
  • reporting functions for Games and comments; and
  • human moderation, report handling and appeals.

2. Technical Requirements and Interoperability

2.1 Baduz requires a current supported web browser, an internet connection and compatible hardware. Certain functions may require JavaScript, WebGL, audio or other browser capabilities. Current requirements are published on the Website.

2.2 Performance depends on the User’s device, connection, browser and third-party infrastructure. Mobile and desktop functionality may differ.

2.3 Games are technically tied to the Baduz engine and runtime. They are not interoperable with external game engines and cannot be exported or operated independently.

3. Content and Moderation Model

3.1 Creators make a mandatory Creator Declaration before publication. At the date of this version, Games are reviewed by human moderators before initial publication.

3.2 At the date of this version, Baduz does not use an automated content detector for publication or moderation decisions. Reviews may also be triggered by reports or conducted as spot checks. If automated detection is introduced, pabolo will update the relevant product and privacy information before deployment where required.

3.3 Game pages may display an info text reporting the Creator Declaration and the maximum 12+ content standard, clarifying that it is not an official USK rating and pointing users to the report function.

3.4 Baduz does not permit public Games that require a 16+ or 18+ classification. Stylised shooting or combat without blood, gore, corpses, graphic injury, torture, execution, dismemberment or realistic suffering may be permitted.

4. Subscription End

4.1 When a Subscription ends, Creator access, contractual hosting and publication rights end immediately. Games and active project data may be unpublished and deleted immediately. Any delayed deletion or continued availability is a revocable courtesy and not a contractual service.

5. No Monetisation

5.1 Baduz does not currently provide virtual currency, in-game purchases, paid user-to-user transactions, Creator payouts or revenue sharing. If this changes, separate or amended terms will apply before such functionality is used.
